AUTHORITY FOR MAJOR PORTS
NOTIFICATION
In exercise of
the powers conferred under Section 49 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby
amends its Order dated 4 February 2000 prescribing the time limit beyond which berth hire
shall not apply for adoption by the Major Ports of the Kandla, Jawaharlal Nehru, Mumbai and the Calcutta, as in the Order appended hereto.

This Authority had passed an Order on 4 February 2000, for common adoption by all the Major Ports, prescribing the time limit beyond which berth hire shall not apply. This Order was notified in the Gazette of India, Extraordinary on 23 February 2000 as Gazette No.18.
2. The Kandla Port Trust (KPT), Jawaharlal Nehru Port Trust (JNPT) and the Mumbai Port Trust (MBPT) have represented against the Order expressing their inability to implement the Order due to tidal conditions prevailing in the channel of these ports. Although, the Calcutta Port Trust (CPT) has not made any representation, knowing its propensity to reckon with tidal factors the CPT was also added to this consideration.
3. With reference to the justification given by the above ports and based on a collective application of mind, our Order dated 4 February 2000 is modified as given below:
In paragraph No.3 of the Order dated 4 February 2000 after paragraph 3 (ii), the following two conditions are included:
(iii). The Master
/ Agents of the vessel shall signal readiness to sail only in accordance with favourable
tidal and weather conditions.
(iv). The time
limit of 4 hours prescribed for cessation of berth hire shall exclude the ship’s waiting period for want of favourable
tidal conditions.
4. The above modification is applicable only to the KPT, JNPT, CPT, and MBPT.
