The Cochin Port Trust                                                         Applicant

O R D E R

( Passed on this 14th day of October 2000 )

This case relates to a proposal made by the Cochin Port Trust (COPT) to include a separate entry in its Scale of Rates prescribing wharfage for cars, trucks and other motorised four wheelers.

2.                      The COPT has stated that in the present Scale of Rates there is no separate wharfage rate for motor cars, vans, trucks and other four wheelers.  In such a case, the rate of 0.20% ad valorem applicable to residual items is made applicable. In anticipation of a substantial volume of traffic under this category in the near future, the COPT has proposed inclusion of this same rate as a separate item in its Scale of Rates.  The COPT has observed that this will avoid any ambiguity in interpreting the Scale of Rates.

3.                      While disposing of a representation received from M/s. Shahi Shipping Limited for fixing coastal tariff at the Cochin Port for import / export of motor vehicles, this Authority through its Order dated 31 August 2000 had advised the COPT to introduce a separate item of wharfage for motor cars in its Scale of Rates, when traffic picked up.   It was also suggested that the port might introduce volume discounts to encourager more throughput.

4.                      The present proposal of the COPT does not envisage revision of rates.  The proposal is to make a specific entry in the Scale of Rates in order to avoid confusions.  Further, this is based on the advice given earlier by this Authority.

5.                      In the result, for the reasons given above, and based on a collective application of mind, this Authority approves the proposal of the COPT to include a separate entry in the wharfage schedule of its Scale of Rates prescribing wharfage for cars, trucks and other motorized four wheelers as given below:

Description

Unit

Rate

Motor Cars, Trucks and other Motorised four wheelers

Ad-valorem

 6.                      The COPT is directed to include the above provision appropriately in its Scale of Rates.
