NOTIFICATION
In exercise of the powers conferred by Section 49 of the Major Port
Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major
Ports hereby extend the period of the interim stay, granted for implementation
of this Authority’s Order dated 29 October 1999 relating to revision of
the rate structure of the Gandhidham Lands of the Kandla Port Trust, as in the
Order appended hereto.

This Authority had passed an Order on 29 October 1999 relating to
revision of the rate structure of Gandhidham Township land of the Kandla Port
Trust (KPT), which was notified in the Gazette of India on 25 November
1999. With reference
to various representations received against the Order, it was decided by
this Authority to review the Order.

A joint hearing was held in the review case on 8 March 2000 at the KPT.
Based on the discussions at the joint hearing, implementation of
the entire Order was stayed until disposal of the review case.
The (extended) period of the stay will expire on 30 November 2001.

The KPT has now submitted on 12 November 2001 a revised proposal for
reviewing the Order of the Authority about revision of rate structure of the
Gandhidham Township Land. This
proposal has already been circulated among various users / representative body
of port users for comments as per the procedure adopted.
A joint hearing will be held whereafter the review case will be taken up
for final consideration. Since
processing of the revised proposal of the KPT will take some more time and the
stay earlier granted will expire on 30 November 2001, it becomes
inevitable to continue with the stay granted for implementation of the Order
dated 29 October 1999 till a final decision is taken on the revised proposal of
the KPT.

Accordingly, this Authority decides to extend the stay granted for
implementation of the Order dated 29 October 1999 relating to revision of the
rate structure of the Gandhidham Township lands of the KPT for a further period
from 1 December 2001 till the disposal of the revised proposal of the KPT
submitted on 12 November 2001.
