In exercise of
the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963), the
Tariff Authority for Major Ports hereby makes amendments in the New Mangalore Port Trust
Scale of Rates relating to fixation of base of lease rent as in the Order appended hereto.

This case relates to a
reference received from the New Mangalore Port Trust (NMPT), about amendments to the Scale of Rates relating to (a) allotment of land on short term licence
basis; (b) lease of land in the port area on long term basis; and, (c) use of landing
places in the NMPT.

It
has been stated that the rates were notified in the Karnataka Gazette on 20 February 97
with the approval of the Government. Consequent
to the Guidelines issued by the MOST vide their letter No. PT/17011/55/87/PT dated 11
March 98, a need has arisen for amending the existing scale of rates in regard to fixation
of the base rate for lease rent every 5 years instead of 7 years as earlier specified in
the MOST Guidelines.

The
Guidelines issued by the Government are applicable uniformly to all the Major Ports. The
Authority has also adopted these Guidelines till its own Guidelines are formulated. Accordingly, the following amendments in the Scale of Rates of the NMPT
relating to (a) allotment of land on short term licence basis; (b) lease of land in port
area on long term basis; and,(c) use of landing places in the NMPT are made :-
(i). The existing
condition under note Sl. No. (1) relating to allotment of land on short term licence basis
may be substituted as under :
The
above licence fee will be increased at a uniform rate at 5% every year rounding off to the
nearest Rupee from the date of publication with an option to the Port Trust to refix the
base every five years.
(ii). The existing condition (a)
under Schedule for long term lease may be substituted as under :
Rs.600.00
per 100 sqm. per month towards lease rent. This
lease rent will be increased at a uniform rate at 5% every year rounding off to the
nearest Rupee from the date of publication with an option to the Port Trust to refix the
base every five years.
(iii). The existing condition under
note vide Sl. No. (2) relating to use of landing places
may be substituted as under :

above licence fee will be increased at a uniform rate of 5% every year rounding off to the
nearest Rupee from the date of publication with an option to the Port Trust to refix the
base every five years.
