Tariff Authority for Major Ports 

Notification   

 In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby approves the proposal of the New Mangalore Port Trust for an extension of the validity of the revised rate of levy applicable to the services of its Registered Cargo Handling Workers Wing as in the Order appended hereto.

O R D E R

(Passed on this 21st day of March 2002)

                        This Authority had passed an Order on 9 August 2001 revising rates of levy applicable to the services of the Registered Cargo Handling Workers Wing (RCHW) of the New Mangalore Port Trust (NMPT), which was notified in the Gazette of India on 29 August 2001.  The NMPT was then advised to formulate within 6 months its proposal for switching over to a commodity-wise per-tonne rate with productivity linkage for deployment of Registered Cargo Handling Workers and the validity of the revised rates was fixed upto 31 January 2002.  

2.                     The NMPT had vide its letter dated 7 January 2002 requested the Authority to extend the validity of the existing rates of levy upto 31 March 2002 which was allowed by this Authority recognising the fact that the NMPT had already initiated action to formulate the proposal as directed.  The Order in this regard was passed by this Authority on 11 January 2002. 

3.                     The NMPT has vide its letter dated 13 March 2002, submitted a proposal for fixation of commodity-wise per tonne rate with productivity linkage for deployment of Registered Cargo Handling Workers. 

4.                     The NMPT has also requested that since the processing of the proposal and finalisation of the rates by this Authority will take time, it is requested that the validity of the existing rate of levy be extended upto 31 May 2002 or till the approval of the rates on tonnage basis for the RCHW wing, whichever is earlier. 

5.                     Recognising the fact that the NMPT has already submitted the proposal for consideration of this Authority and the processing of the case following the procedure prescribed will take some time, this Authority is inclined to allow the existing rates to operate till a new rates are prescribed. 

6.                     In the result, and based on a collective application of mind, this Authority extends the validity of the existing rates of levy applicable to the services of the NMPT RCHW till disposal of the proposal for revision of these rates received now.
