Authority for Major Ports
Notification
In exercise of the powers conferred by Section 49 of the Major Port
Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major
Ports hereby amends the Scale of Rates governing licensing of semi-paved
stackyard on short-term licence basis at the New Mangalore Port Trust as in the
Order appended hereto.

This Authority had passed an Order on 5 November 2001 in case No.TAMP/31/2001-NMPT
approving the Scale of Rates governing licensing of semi-paved stackyard on
short-term licence basis at the New Mangalore Port Trust (NMPT).
This Order was notified in the Gazette of India, Extraordinary
(Part III Section 4) on 3 December 2001 vide Gazette No.324.

This Authority has not yet prescribed its own guidelines governing
leasing of lands of the major port trusts.
This Authority has, therefore, adopted the guidelines in
this regard issued from time to time by the Government of India in the Ministry
of Shipping until formulation of its own guidelines.

While notifying the Scale of Rates governing licensing of semi-paved
stackyard on short-term licence basis at the NMPT, the provisions
available in the Government guidelines for an annual escalation in the licence
fee and also re-fixation of base rate of lease every five years were
inadvertently omitted. Likewise, the fact that the licence fee of Rs.
600/- per 100 sq. meter per month for open space is subject to an annual
escalation @ 5% p.a. (compounded) from its notification in the
Karnataka Gazette dated 20 February 1997 has also not been specifically
indicated.

In order to rectify the errors that crept in due to oversight, it
has now become necessary to amend the earlier Order dated 5 November 2001.
This Authority, therefore, approves the following
amendments / modifications to the earlier Order dated 5 November 2001:-
(i).
Paragraph 7.1. (i) is deleted and substituted by the
following:
“Approval
of a monthly licence fee as applicable for open space notified in the Scale of
Rates of the NMPT with retrospective effect from February 2000 till 2 December
2001.”
(ii).
A new paragraph 7.1. (iii) as follows is added below
paragraph 7.1. (ii):
“The
licence fee shall bear an escalation @ 5% (compoundable) per annum with effect
from 3 December 2001. The
NMPT will have an option to re-fix the base rate of the licence fee every five
years.”
