Authority for Major Ports
Notification
In exercise of the powers conferred by Section 49 of the Major Port
Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major
Ports hereby closes as withdrawn the case relating to the proposal of the New
Mangalore Port Trust for revision of lease rentals for its lands as in the Order
appended hereto.

This case relates to a proposal received from the New Mangalore Port
Trust (NMPT) for revision of lease rentals for its lands leased on long
term/short term basis.
2.1.
The proposal of the NMPT was registered as a tariff case and processed
following the consultation procedure prescribed.
A joint hearing in this case was also scheduled to be held on 3 May 2002
at the NMPT premises.
2.2.
A few days before the scheduled joint hearing, the NMPT informed that it
desired to place the proposal before its Board of Trustees for discussion; and,
accordingly, requested this Authority to postpone the joint hearing by about a
month.
2.3.
In the first week of June 2002, the NMPT made another request to postpone
the joint hearing by about 60 days since its Board of Trustees desired to have
further discussion/clarification on the proposal.

Since the proposal of the NMPT has been registered as a tariff case, it
is not desirable to keep it pending indefinitely.
At the same time, it serves no purpose to order a tariff arrangement
based on the original proposal of the NMPT when the Port itself does not want to
pursue it.
4.
In the light of the position explained above, this Authority decides to
close the case as withdrawn. When a
revised proposal, if any, is received from the NMPT, it will be considered
afresh then.
